These Terms of Service ("Terms") govern your access to and use of the games, apps, websites, and related services (collectively, the "Services") provided by FuzzyCastle Games ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

We may update these Terms at any time. We will notify you of material changes via email or in-app notice where possible. Your continued use of the Services after changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

1. Eligibility and Account Creation

You must be at least 13 years old to use the Services (or older if required by law in your jurisdiction). If you are under 18, you represent that you have parental or guardian consent to use the Services. Parents/guardians are responsible for their child's compliance.

To access certain features, you may need to create an account using credentials from providers like Google. You must provide accurate information and are responsible for all activities under your account. You agree not to share your account or use another's without permission.

2. Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized use. We are not liable for losses due to your failure to secure your account.

3. Usage and User Conduct

Our Services are provided for personal entertainment purposes only. You agree not to misuse, exploit, or interfere with the Services, including authentication, game mechanics, or other users.

Prohibited activities include, but are not limited to:

• Cheating, hacking, using bots, exploits, or unauthorized software.
• Harassing, threatening, or bullying other users.
• Posting obscene, defamatory, or illegal content.
• Impersonating others or infringing intellectual property.
• Spamming, phishing, or distributing malware.
• Engaging in real-money trading of in-game items (if applicable).
• Violating any laws or these Terms.

We reserve the right to monitor usage and take action, including warnings, suspensions, or bans, for violations.

4. Intellectual Property

All content in the Services, including games, graphics, code, audio, and trademarks, is owned by us or our licensors and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, revocable license to use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, reverse-engineer, or create derivative works without our written consent.

If the Services allow user-generated content (e.g., custom avatars or chat), you retain ownership but grant us a worldwide, perpetual license to use, modify, and distribute it for operating and promoting the Services. You represent that your content does not infringe third-party rights.

5. Payments and Virtual Items

If the Services include in-app purchases, subscriptions, or virtual currencies/items, all payments are final and non-refundable unless required by law. Prices may change without notice. You are responsible for applicable taxes and fees. We may suspend access for failed payments.

Virtual items have no real-world value and remain our property. We may modify or remove them at any time.

6. Termination

We may suspend or terminate your account and access to the Services at any time for violations, or if we discontinue the Services. Upon termination, you lose access to virtual items or progress without refund. You may terminate by deleting your account.

7. Disclaimer of Warranties

The Services are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee error-free, secure, or uninterrupted access. Use at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility. Our total liability is limited to the amount you paid us in the past 12 months, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms, misuse of the Services, or infringement of third-party rights.

10. Dispute Resolution and Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of laws. Any disputes shall be resolved through binding arbitration, excluding class actions. You waive jury trials.

12. Miscellaneous

• Severability: If any provision is unenforceable, the rest remain in effect.
• Entire Agreement: These Terms constitute the full agreement, superseding prior versions.
• Force Majeure: We are not liable for delays due to events beyond our control (e.g., natural disasters).
